1. Acceptance of terms

By downloading or using Genesis by Parafield, our app for iPhone and iPad (the "Genesis app" or "the app"), and the online services it uses (together, "the Service"), operated by Parafield Inc., you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Our websites, including app.parafield.ai and Genesis Reader at genesis.parafield.ai, and the Parafield iOS app are covered by the Parafield Terms of Service, not by these Terms.

2. The Genesis app

The Genesis app lets you browse and listen to narrated spatial-audio stories that we publish. You need a Parafield account to start using the app. It does not generate audio from your prompts and offers no purchases; the stories in it are free to listen to. If we add purchases, we will update these Terms before they appear in the app.

3. Accounts

  • You need a Parafield account to start using the Genesis app. You can create an account with Apple or Google, or with an email address where we offer that. An account created with Sign in with Apple works only in the Genesis app for now.
  • You must be at least 13 years old, or the minimum age of digital consent where you live, to create or use an account. If you are under 18, you need a parent's or guardian's permission.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account.
  • You must notify us promptly if you become aware of any unauthorized use of your account.

4. Acceptable use

You agree not to:

  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated tools, bots, or scripts to scrape, crawl, or extract data from the Service without prior written permission.
  • Interfere with or disrupt the Service or its infrastructure.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Circumvent any rate limits, access controls, or security measures.
  • Use the Service in a manner that could damage, disable, or impair it.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Copy, record, download, or redistribute Genesis content, or share its playback links, except as the Genesis app allows.

5. Content and intellectual property

Genesis content. The recordings, narration, sound design and production in the Genesis app are owned by Parafield Inc. or its licensors. Some stories are based on texts in the public domain; this license covers our recordings, not those texts. Genesis narration and sound are produced with the help of AI tools. Subject to these Terms, we grant you a personal, non-commercial, non-transferable, revocable license to listen to Genesis content in the Genesis app.

Your content. You retain ownership of the information you provide to the Service, such as your profile. By submitting it, you grant Parafield a limited, non-exclusive license to process it for the purpose of operating the Service.

Our intellectual property. The Parafield name, brand, logo, user interface, design, underlying technology, and all related intellectual property are owned by Parafield Inc. These Terms do not grant you any right to use our trademarks, branding, or proprietary technology beyond normal use of the Service.

6. Service availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on a best-effort basis.

  • We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
  • We may perform maintenance that temporarily affects availability.
  • We are not liable for any downtime, data loss, or service interruption.

7. Limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARAFIELD INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

8. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties.

You may delete your account at any time in the Genesis app (Profile, Settings, Delete account), unless the app tells you the account is also used on our websites; then delete it from Settings in your account menu at app.parafield.ai. Deleting an account ends sign-in with it everywhere you use it. What happens to the information we hold is described in our Privacy Policy, including information that deleting in the Genesis app does not remove and how to have it removed.

9. Apple App Store

If you downloaded the Genesis app from the Apple App Store, Apple's Licensed Application End User License Agreement applies to the app together with these Terms, and the following also applies. In this section, "the developer" is the developer named on the app's App Store page, which licenses the app to you, and Parafield Inc. operates the Service the app uses.

  • These Terms are between you, the developer and Parafield Inc., not Apple. The developer and Parafield Inc., not Apple, are responsible for the app and its content.
  • Your license to the app is a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts associated with you through Family Sharing or volume purchasing may also use it.
  • The developer and Parafield Inc., not Apple, provide support for the app: email support@parafield.ai. Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • Apple is not responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
  • The developer and Parafield Inc., not Apple, are responsible for investigating, defending, settling and discharging any claim that the app or your use of it infringes someone else's intellectual property.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Questions, complaints or claims about the app go to the developer and Parafield Inc. at the email addresses in Section 12.
  • You must comply with any third-party terms that apply when you use the app, such as your wireless data service terms. If you use Sign in with Apple, Apple provides it under its own terms.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the app, and Apple may enforce these Terms against you.

10. Changes to these terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

11. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
